secret search

The Supreme Court on Monday turned away a preliminary challenge to the government's expanded powers to wiretap and search people who are suspected of having links to foreign terrorists.

Can I file suit to find out if I'm the victim of a secret search? Because they'd throw it out if I weren't, right? But if I was, they'd have to tell me and I could go forward with my suit. That's the only way I figure this ruling could possibly make any sense at all. If that's not the case, then they should let the ACLU represent the unnamed and unrepresented victims en masse.
