Rule 11

Rule 11 deals with frivolous lawsuits. See people complain all the time about frivolous lawsuits, but they really don't exist. Every lawsuit that is out there, some judge thought that it had at least some merit, otherwise he would have thrown it out of court. Rule 11 is for the other side's lawyers. If they feel that a lawyer is taking on a completey frivoulous lawsuit with no merit, they can file a Rule 11 motion. This is very serious. If the judge agrees that the lawsuit is totally frivolous and wasting the courts time, he will rule in favor of the motion and not only will the case be thrown out of court, but the lawyer has displinary actions filed against him, often times leading to dis-barrment.

This is you friendly law "fact-o-the-day" compliments of Tracy Soltesz.
